What motions are needed to convert a Chapter 7 bankruptcy to Chapter 13 to stop a foreclosure auction?
Full conversation
I need to have Chapter 7 extended cause the previous discharge was fraudulent since it did not remove Lien that it was supposed to remove form my property.
I understand how concerning it must be to deal with a fraudulent discharge and its impact on your property. Can you please provide more details about the lien that was supposed to be removed?
These were fraudulent liens applied by law firms that never provided any work for me. I was told that they would be removed with a Chapter 7 but they never were. Now I need to extend a Chapter 7 that as already reopened.
Have you already filed any motions or taken any legal steps regarding this issue?
Yes but the Judge has been slow to act and it's almost a year and my bank is trying to foreclose on my home. I need to file for an Extension and a conversion.
Is there anything else the Real Estate Lawyer should know before I connect you? Rest assured they'll be able to help with your Chapter 7 extension.
No.
Hi there! My name is Seth, and I am a licensed attorney. Please know that my responses are for general information only and do not constitute legal advice. Also, you may experience a wait time between responses. That is because I work with multiple customers at the same time. Please know that I will respond as soon as I can. I appreciate your patience. I am reviewing your question now… Could you share more details about the fraudulent liens and the Chapter 7 extension you are seeking?
The fraudulent liens were applied by a local prosecutor acting under an offshore entity.
Could you tell me if there were any legal proceedings or documentation related to these liens applied by the local prosecutor?
Under an offshore entity he controls. It allows him to takeover my home for Zero dollars. There were no legal proceeding regarding me or my property which involved him.
Thanks for sharing that. Could you let me know if the Chapter 7 bankruptcy case you mentioned was initially filed to address these liens, or were they discovered afterward?
My previous BK attorney assured me they would be removed.
Based on your situation, there are several legal arguments and considerations in bankruptcy law that could potentially support your case:
- Fraudulent Liens: If liens were applied fraudulently, they may be challenged in court. Fraudulent liens are those that are filed without a legitimate basis or through deceitful means.
- Chapter 7 Bankruptcy: Typically, Chapter 7 bankruptcy can discharge many types of debts, but it may not automatically remove liens from property. A separate legal action, such as a motion to avoid the lien, might be necessary if the lien impairs an exemption.
- Reopening Bankruptcy Cases: Bankruptcy cases can be reopened to administer assets, accord relief to the debtor, or for other cause. If the discharge did not address the liens as expected, reopening the case might be a viable option.
- Judicial Process: The slow response from the judge may be due to the complexity of the case or backlog in the court system. It's important to ensure all necessary documentation and motions are properly filed to facilitate the process.
Let me know if you have any questions or clarifications, if not I'll move forward with guidance.
I had a Discharge in September 2024. The BK filed was purely to remove the liens so I could sell my home. My home had over 600k in equity at that time.
- Review Discharge: Confirm whether your Chapter 7 discharge addressed the liens; if not, that may explain why they remain.
- Reopen Case: Consider filing a motion to reopen the bankruptcy to address unresolved lien issues.
- File Motion to Avoid Lien: If the lien impairs an exemption, seek court removal through a lien avoidance motion.
- Challenge Fraudulent Liens: Pursue legal action to invalidate any liens placed fraudulently.
Please let me know if you have further questions.
The Chapter 7 was reopened in may 2025 due to various irregularities and criminal activity regarding my home. In one year, I have not been able to have one hearing or assigned a Trustee and am unable to obtain a BK attorney because the local prosecutor is boycotting me as a whistleblower.
I hear you! Were you able to see my answer above? If so, please let me know if there is anything you need me to help clarify regarding it.
I wish to convert to a Chapter 13 with an Emergency Conversion to stop the Foreclosure Auction scheduled for May 21st. Convert to a 13.
Converting to Chapter 13 can potentially stop a foreclosure auction, as it generally triggers an automatic stay that halts foreclosure proceedings. However, the timing is crucial, and it's important to file the conversion and any necessary motions as soon as possible to ensure the stay is in place before the auction date. Please let me know if you have any further questions.
Hi there! Checking in to see if I was able to resolve your concerns today? Please let me know if I can help clarify anything else. I want to ensure you are satisfied with my services.
Can you please clarify which Motions are necessary to file?
To convert your Chapter 7 case to Chapter 13 and stop the foreclosure auction, you typically need to file a Motion to Convert with the bankruptcy court under (11 U.S.C. § 706). This motion requests the court's permission to change your bankruptcy case from Chapter 7 to Chapter 13.
Additionally, you may need to file an Emergency Motion to Stay Foreclosure Proceedings, which relies on the automatic stay provisions under (11 U.S.C. § 706) that generally halt collection and foreclosure actions once a bankruptcy case is filed or converted. This motion asks the court to halt the foreclosure auction while your conversion is being processed. It's important to act quickly and ensure all paperwork is correctly filed to maximize your chances of stopping the auction.
Thank you.
